Petrus Bernardi, a canon of the Holy Sepulchre, with the consent of Petrus prior and his fellow canons, permits Andreas and his wife Hosanna to build a house on land belonging to the Holy Sepulchre in that part of the city of Jerusalem which is under royal jurisdiction. The land adjoins a house belonging to the Holy Sepulchre, a house of the Hospital of St John which used to be owned by Garsia, and a house which belonged to Robertus Galatinae. Andreas and Hosanna must pay a rent [redditus] of 2 besants a year to the Holy Sepulchre. If either Andreas or Hosanna should die, the surviving spouse can continue to live in the house while paying the same rent. After the death of both the house will pass to the Holy Sepulchre. The canons also allow Andreas and Hosanna to draw water for their needs from the canons’ cistern which is at the foot of the steps [ad pedes gradus]. Petrus Dominici Sepulcri prior, together with the canons, gives Arnulfus, the son of Bernardus/Bernaldus Syrianus, and his heirs houses built over vaults exchanged with the Hospital [of St John] and situated over the Holy Sepulchre’s oven, which is on the road that leads to Mt Sion, and a statio next to the oven for an annual census of 9 besants, payable at Easter. If the bases of the houses resting on the vaults are damaged, that party, the Holy Sepulchre or Arnulfus, which has been negligent will be responsible for repairs. If Arnulfus extends the houses and wishes to sell, the Holy Sepulchre will have preemption rights, paying 1 silver mark less than the price. Otherwise any purchaser, burgensis vel Syrianus, will be subject to the same rent. The cost of any repairs to the statio will be borne by Arnulfus. The canons give custody of the key to the cistern to Arnulfus, who must provide the procurator of the oven with water if he needs it when making repairs. text: May 24. Rotbertus de casali S. Egidii and his wife Odula state that, with the agreement of Rohardus and his wife domina Gilla, from whom they held the feudum, and with the confirmation of King Fulk, Queen Melisende and Patriarch William, they had leased the land [of Emaus] to Raimundus magister and the Hospital of St John of Jerusalem, on condition that Raimundus and the Hospitallers gave them 500 besants a year, half payable at Easter and half on the Feast of All Saints, as recorded in charters issued by the king of Jerusalem and the patriarch. But now, in changed circumstances, Raimundus magister and the brothers of his chapter have agreed to a modification of terms requested by Rotbertus and Odula. The rent will in future by paid annually in 3 instalments: 200 besants at Easter, 100 on the Feast of St John the Baptist, 100 on the Feast of All Saints and 100 at Christmas. If the rent is not forthcoming for 40 days Robert and Odula can reoccupy the land until the rent is paid. Their lord Rohardus and his wife Gilla agree as an eleemosynary grant that up to 100 besants can be sold to, exchanged with or given to the Hospital. Should the family of Rotbertus fail and the feudum revert to its lord, the Hospital will be bound solely to pay a rent of 400 besants a year.
