Pope Urban III confirms for Rogerius magister and the brothers of the Hospital of St John of Jerusalem the masked eleemosynary grant of the lordship and castellum Margati to them by Bertrandus dominus Margati, for the needs of Christianity but also because Bertrandus can no longer bear the expenses and the close proximity of the infidels. The pope records that the grant was made with the consent of Prince B. of Antioch, with the advice of Patriarch A. of Antioch and at the will of Count R. of Tripoli. The pope incorporates the charter of Bertrandus [Feb. 1. 1187]. Bertrandus Margati dominus, the son of dominus Reinaldus, quondam ejusdem castelli dominus, with the agreement of Prince Bohemond III of Antioch, Count Raymond III of Tripoli and his wife domina Bermunda, with the advice and at the instigation of dominus Anterius Valenie episcopus, and with the agreement of all his men [homines] having ius, feudum or hereditas in the territory, both milites and burgenses, makes a sealed eleemosynary grant to the Hospital of St John of Jerusalem, represented by dominus Rogerius de Molins, eiusdem domus venerabilis magister. He gives the castle [castrum] called Margat with all its lands and rights, including his dominationes and ligiantiae. In return, the magister, his successors and brothers will pay Bertrandus and his legitimate heirs 2200 Saracen besants each year, payable in the city of Tripoli by the castellan [castellanus] of Cractum in 4 instalments, namely 550 besants each at Easter, the Nativity of St John the Baptist, the Feast of the Exaltation of the Cross and Christmas. If Bertrandus should die without legitimate heirs, the Hospital will pay Bermunda, or another legitimate wife, 1200 besants each year, retaining the balance of 1000 besants as an alms gift. If on the death of Bertrandus there are heirs, the rent should be divided, with 1100 going to his wife for her lifetime and 1100 to his heirs. The 2200 Saracen besants will thereafter go totally to the heirs, but if the line should fail, the rent will revert as an alms-gift to the Hospital. The pope also incorporates, with some differences, the confirmation charter of Prince Bohemond of Antioch. Bohemond III, dei gratia princeps Antiochenus, the son of Prince Raymond, with the advice of Patriarch Aimery of Antioch and the agreement of his wife domina Sibilla Antiochie principissa, his sons the milites Raimundus and Boamundus, and many others - clerics, milites and burgenses - confirms under seal the gift of dominus Bertrandus to the brothers of the Hospital of St John of Jerusalem of the city of Valenia and the castle [castellum] of Margatum with villani, casalia and guastinae, together with the milites and men [homines] living there and holding fiefs [feodi et feodati], on the same terms as they were held by B. and his father R., with the following exceptions: casale Assenem, which lord R. gave Bohemond pro novesimo de se et hominibus suis; the houses of Bertrandus in Antioch, which he sold and gave away; an oven, which he gave to [the monks of] Iubinum; and the terra de Gereneis which the prince retains for himself, although he promises to give it to no other religious order than the Hospital and adds that if he should give it to a layman, it will be held in the Hospital’s lordship. Bohemond confirms the possession by the Hospital of the dependencies of the feodum Margati: Margatum, Cademois, Laycas, Malaycas, Bokebeis, casale Belne, and in the principality of Antioch, Fassia with its guastinae and dependencies by land and sea, casale Cymas, abbatia Montis Parlerii, the villa called Russa, casale Farangi, casale Come, casale Pospos with its casale, casale Caynon, casale Aliis, abbatia S. Gregorii, which is in Montana Nigra with its casalia and guastinae, Rogia with its guastinae, casale Belmesyn, casale Besselemon, casale Luzin, caveae Belmys, casale Casnapor, casale Colcas, casale Corconai and Meunsarac which are in the mountains of Mons Parlerius, Pocania and Pangeregan which are in the vallis Russa, Andesyn, abbatia de sancta Maria, casale Bodoyke, half of the casale called Gorrosie, casale Massabe. Possession of these, with milites, homines and villani and all rights is confirmed as an eleemosynary grant, to benefit especially the soul of Bohemond’s father Raymond. The Hospital of St John is to hold all this freed from any servitium. Bohemond confirms everything that dominus Rainaldus had in Antioch, including a bath house, and [the lordship of] all the milites of the castrum of Margatum with the servitii and feodi previously owed to dominus R. Maserius and dominus B. The Hospitallers may retain all loot taken from the enemy. They are not bound to observe truces made by Bohemond with the Sarraceni. If they make truces with the enemies who are in the feudum of Bokebeis or are before Gabulum, Bohemond will observe them if notified. The Hospitallers are free to bring in or take out, sell or buy their goods throughout the whole of the principality without payment of any exaction, but if their homines sell or buy goods that are not the property of the Hospital the accustomed duty [consuetudo] will be payable to the prince’s curia. If any of the prince’s subjects [homines], who are Franci, give any burgesia, the Hospitallers may sell it after holding it for a year and a day, provided it is not a holding that owes servicium, but they cannot acquire any feudum held by a miles or cliens without the prince’s permission. If any of the prince’s villani, whether Sarraceni or homines, enter the territories of Valenia or Margatum or other holdings, the Hospitallers should return them according to law and custom [iuxta assisiam et consuetudinem terre], but they may retain Christians and those who make peace with the prince. The prince will act similarly with respect to villani of the Hospital. In return for the prince’s alms-gift the magister and the brothers of the Hospital have given Bohemond out of charity 8000 Saracen besants and have given his sons R. and B. 1000 Saracen besants each.
