[43] When Petrus Sancti Lazari, a confrater [frater] of the church of the Holy Sepulchre, died, his daughter, who was a minor, and her mother asked to be able to hold the feodum of Sancti Lazari for their sustenance until the daughter should marry, after which the service owed for the fief would be resumed. When the daughter reached marriageable age the canons wanted to marry her to their famulus Petrus, whom they had brought up [noster nutritus]. The mother was vehemently opposed although she did not want to lose the fief in her lifetime. Brought with her mother, step-father [victricus], male protectors [patrini] and other lay people before Patriarch Stephen and the canons in chapter, the daughter stated that she would rather beg than marry against her mother’s will. She returned the fief to the canons on condition that her mother and step-father should continue to enjoy it for their lives. W[illelmus], third prior of the church of the Holy Sepulchre, records the canons’ agreement and their decision to provide for the son of the mother and her husband after their death. text: 1130 – Aug. 31 1133. Bernardus Bituricensis and his wife Ahoys make an eleemosynary grant to the canons and church of the Holy Sepulchre. They give their house and whatever else they have, including a piece of land near the gate of St Stephen in Jerusalem, which they acquired in return for the payment of a census of 2 besants. They will remain in possession of the house and their other property for their lives. After their deaths a third part of the property is to pass to the canons, although if one of them survives a further third part can pass to the canons in return for support for the rest of the survivor’s life. A third part will go to their daughter and her heirs, if she marries, although it can be exchanged with the canons for 100 besants and if she dies childless it will also pass to the canons. Petrus prior Sancti Sepulchri takes Bernardus and Ahoys into confraternity, in recognition of which Bernardus and Ahoys will give the the church a justa of wine and 2 loaves three times a year: at Christmas, Easter and on the 15 July [Festum Jherusalem]. P[etrus] Dominici Sepulcri prior and his convent record that they conceded to Bernardus and his wife, who had been received into the confraternity of the Holy Sepulchre, a house with a statio, to be held for their lives, with the exception of 2 camerae and stables [stabulae], which the canons of the Holy Sepulchre will retain for the lodging of Lambertus Ptolomensis. After the death of Lambertus and his wife the Holy Sepulchre will provide Bernardus with compensation. If Bernardus and his wife decide to abandon their property and enter the community they will be provided with food and clothing. When one of them dies half of their goods will go to the Holy Sepulchre and the survivor may join the community with the other half or can continue to live in the house. After the survivor’s death the house and statio will pass to the the canons. If Bernardus and his wife should have a child he or she will inherit one third of any cash, but the rest, together with the house and statio, will pass to the Holy Sepulchre. If the survivor of the couple remarries he or she should have the property for life, but it will not be held by any new wife or husband after the survivor’s death, although she or he may retain half of any cash. If there is a child of this second marriage the cash will be divided, with a third going to the Holy Sepulchre, a third to the child, and a third to the spouse. Record of an agreement made between Maria de Sancto Lazaro, the wife of Rogerius, a cliens of the Holy Sepulchre, and Bernardus, the brother of Petrus prior Sancti Sepulcri and a cliens of the patriarch. Maria had wedded her daughter to Bernardus in the presence of the chapter of the Holy Sepulchre. Her first husband Petrus had presented the daughter with a dowry of 100 besants and had invested her with the usufruct of a vineyard that he had planted. Petrus also left Bernardus a fourth part of a house situated in Jerusalem in the platea Templi next to the house of Bentulinus, to be held after his death. Another part was left to his son, although it would pass to Bernardus if the son died. Maria challenged the gift of the house. The case was heard in the chapter of the Holy Sepulchre in the presence of patriarcha Willelmus; Petrus subprior; of the canons of the Holy Sepulchre, Anselmus cantor; Goffridus thesaurarius; magister Robertus; and in the presence of Anschetinus, quondam vicecomes Hierosolymitanus; Rainaldus de Pontibus; Goiffridus Acu. They judged that Bernardus should have the fourth part of the house acquired by Maria and her second husband Rogerius after their death; similarly another fourth part should pass to Bernardus after the death of Maria’s son. In the presence of Patriarch William of Jerusalem, who seals the charter, Riso, capellanus to Bohemond I and Bohemond II of Antioch, gives the canons of the Holy Sepulchre his houses with an apple orchard [pomerium], which he had bought from Willelmus medicus for 64 besants. They are to hold it under the same terms as he held it from Bohemond II. The houses are situated next to those of Pontius Antiocheni thesaurarius on the other side of the public way [via publica]. Riso reserves for himself one camera, to provide a small living place [habitaculum] for his servus, whom he has had baptized, for as long as he lives and serves him faithfully. Petrus prior Dominici Sepulcri records that, together with some of his canons, he travelled from Jerusalem to Antioch to investigate the rights enjoyed by the church of the Holy Sepulchre in the time of the Greeks [Greci] and then under the Turks [Turci]. He found 2 mills, one standing, the other ruined, on the banks of the River Orontes at the head of the bridge leading to the Gate of the Count [of the city], which the Holy Sepulchre had once owned by hereditary right. Having investigated the matter with lord Raymond [of Poitiers], princeps ejusdem civitatis, and husband of Constantia and having taken evidence from elderly Suriani, it was agreed to put the 2 water wheels [duas rotas a parte fluminis] at [one of] these mills, called Funeidec, into the custody of three Suriani called Nicheforus, Michaelis and Nicholas for them and their heirs to hold in feodo villaniᶒ on condition that they meet the expenses in materials required in rebuilding the mill and the barrage [exclusa] for the mill race. In return they will have half of all the profit they make from milling and from fishing, although the division of produce between them and the Holy Sepulchre will only take place in the presence of the canons’ famulus, who will hold the key to the mills. If the mill should be damaged the Syrians will rebuild it; on a third refusal to rebuild the mill will be confiscated. If a miller is convicted of theft he will repay either in marcibans or in besants. If he cannot repay the money will be expropriated by a canon or by the canons’ famulus. The villania cannot be sold or pledged without the permission of the chapter of the Holy Sepulchre. Patriarch William of Jerusalem and Petrus gloriosi Sepulcri prior, together with all its canons, record an agreement with the Hospital of St John of Jerusalem, approved by King Fulk and his principes, relating to the land of Emaus given to the Hospital by Robertus de casale S. Egidii. The canons of the Holy Sepulchre will have half the tithes of all harvest, whether of wheat and barley, beans and chickpeas, lentils and peas, and other vegetable crops, or vines and olive trees. The Hospitallers will have the rest of the tithes, in order to manage their chapels and churches, in which they will have full parochial rights. With respect to the casalia they hold in the adjacent hills - casale Huldre; casale de Porcel; casale de Gaufrido Agule; casale de Ansquetino; casale de Bacheler; casale de Gerardo Bocher – or others they may acquire, they will pay the canons half tithes. If the harvest in a casale, whether cultivated by Christians or Muslims [Sarraceni], is commuted for money, the canons will still get half tithes. If the bases of the houses resting on the vaults are damaged, that party, the Holy Sepulchre or Arnulfus, which has been negligent will be responsible for repairs. If Arnulfus extends the houses and wishes to sell, the Holy Sepulchre will have preemption rights, paying 1 silver mark less than the price. Otherwise any purchaser, burgensis vel Syrianus, will be subject to the same rent. The cost of any repairs to the statio will be borne by Arnulfus. The canons give custody of the key to the cistern to Arnulfus, who must provide the procurator of the oven with water if he needs it when making repairs.
