Petrus Dominici Sepulcri prior, together with the canons, gives Arnulfus, the son of Bernardus/Bernaldus Syrianus, and his heirs houses built over vaults exchanged with the Hospital [of St John] and situated over the Holy Sepulchre’s oven, which is on the road that leads to Mt Sion, and a statio next to the oven for an annual census of 9 besants, payable at Easter. If the bases of the houses resting on the vaults are damaged, that party, the Holy Sepulchre or Arnulfus, which has been negligent will be responsible for repairs. If Arnulfus extends the houses and wishes to sell, the Holy Sepulchre will have preemption rights, paying 1 silver mark less than the price. Otherwise any purchaser, burgensis vel Syrianus, will be subject to the same rent. The cost of any repairs to the statio will be borne by Arnulfus. The canons give custody of the key to the cistern to Arnulfus, who must provide the procurator of the oven with water if he needs it when making repairs. Bertrandus Margati dominus, the son of dominus Reinaldus, quondam ejusdem castelli dominus, with the agreement Prince Bohemond III of Antioch, Count Raymond III of Tripoli and his wife domina Bermunda, with the advice and at the instigation of dominus Anterius Valenie episcopus, and with the agreement of all his men [homines], both milites and burgenses, having ius, feudum or hereditas in the territory, makes a sealed and masked eleemosynary grant for the support of the poor in the Hospital of St John of Jerusalem, represented by dominus Rogerius de Molins, eiusdem domus magister. He gives the castle [castrum] called Margat with all its lands and rights, including his dominationes and ligiantiae. In return, the magister, his successors and brothers will pay Bertrandus and his legitimate heirs 2200 Saracen besants each year, payable in the city of Tripoli by the castellan [castellanus] of Cractum in 4 instalments, namely 550 besants each at Easter, the Nativity of St John the Baptist, the Feast of the Exaltation of the Cross and Christmas. If Bertrandus should die without legitimate heirs, the Hospital will pay Bermunda, or another legitimate wife, 1200 besants each year, retaining the balance of 1000 besants as an alms gift. If on the death of Bertrandus there are heirs, the rent should be divided, with 1100 going to his wife for her lifetime and 1100 to his heirs. The 2200 Saracen besants will thereafter go totally to the heirs, but if the line should fail, the rent will revert as an alms-gift to the Hospital. Frederick, de gratia Romanorum imperator semper augustus, Ierusalem et Sicilie rex, records that frater Hermannus magister domus sancte Marie Theotonicorum in Ierusalem and his brothers came into his presence and asked that he restore to them the terra Turonis, now held by the Sarraceni, because it had belonged to the comes Iozelinus, whose domain Frederick, with the agreement of his wife the empress Isabella, had conceded to them. Frederick had acceded to their request, but Alysa, the niece of the late Henfridus iuvenis, came to Frederick’s curia, proved that she had the right to the terra Turonis and asked the he order the land to be restored to her according to the judgement of the High Court [iuxta exguardum curie nostre]. Then the magister and brothers of the Hospital of St Mary of the Germans had produced a charter issued by King Guy of Jerusalem [of 21 October 1186], with the agreement of his consort Sybilla, in which Guy gave comes Iozcelinus and his heirs Toronum and Castrum Novum, together with Maron, Quabrinquen, Belide, Cades, Lahare, Mees and the 2 Megarae, on condition that if they were taken away by the judgement of the curia or if agreements between King Baldwin [IV] and Henfridus iuvenis were made [over] Maron, Henfridus iuvenis and his heirs would hold Turonum and Castrum Novum. The magister and brothers asked that they should enjoy the terms of the agreement, which specified that Henfridus iuvenis and his heirs would hold Turonum and Castrum Novum in exchange for an annual rent of 7000 Saracen besants and Maron and its dependencies, Quabrinquen, Belide, Cades, Lahare, Mees and the 2 Megarae. Frederick grants under seal what they have requested, stating that the rent should be divided equally between the cathena and funda of Acre, payable 4 times a year in instalments of 1750 Saracen besants. The Knights Templar will keep the street in repair to allow the brothers of St Lazarus access to the water in their cistern, which is on the other side of the public way next to a house and boveria of the Templars. text: Jul. 7. Acre. In palatio magistri hospitalis sancte Marie Theotonicorum. Frater Henricus de Honloch magister and the chapter of the Hospital of St Mary of the Germans on one side, and dominus Iacobus de Amigdala on the other, reach an agreement, sealed with the seals of the chapter and of Iacobus, over certain charters of comes Iozolinus relating to the land of Maron, rents of 7000 besants, which Iozolinus had from the funda and cathena of Acre, and other rights which Iozolinus had in the kingdom of Jerusalem. Iacobus claimed half of these by reason of his inheritance from his mother domina Agnes, the daughter of comes Iozolinus. After the intervention of friends, the parties agree the following. With the consent of his brothers in convent, frater Henricus recognizes Iacobus as the legitimate heir and invests him with half of Maron, half of the rents of 7000 besants, and half of the rights of Iozolinus in the kingdom of Jerusalem. Dominus Iacobus de Amigdalia renounces claims to the other half of Maron and the other rents and rights of Iozolinus. He agrees that the original charters should be held by the Hospital of St Mary of the Germans, who had bought the estates from domina Beatrix, the first-born daughter of Iozolinus, reserving claims to half of other properties, should they be restored to Christian hands. He promises never to challenge his sale to the Order of half of Castrum Regis for 6400 besants. or his leasing to the Order of half of Maron for an annual rent of 2500 besants, which is described in a separate charter. He agrees that should other properties, at present held by the Sarraceni, return to Christian hands, he will seek arbitration. He will never encourage any other individual to take action against the Order. Any breach of this agreement will carry a penalty of 2000 marchae argenti.
