Pope Alexander III renews for Nicholaus prior and the canons of the Holy Sepulchre the papal protection granted them by his predecessors Popes Honorius II, Innocent II, Celestine II, Lucius II and Eugenius III and he confirms their possessions, referring specifically to confirmations by the patriarchs of Jerusalem of the grants of half of all oblations to the Holy Sepulchre; oblations to the relic of the True Cross, except on Good Friday and when the patriarch has need of them; the tithes of the city of Jerusalem and lands around, except for those from the funda; and the church of St Peter in Jaffa. He confirms the possessions and rights of the canons of the Holy Sepulchre in the Iberian peninsula [Yspania]. He exempts them from the payment of tithes on noval lands, cultivated by themselves or at their expense, and on animal fodder. He forbids the transfer of brothers from the community without the licence of prior and chapter.

He confirms the grants made by Duke Godfrey, King Baldwin I, Patriarch Arnulf and their successors, specifying the following: in the bishopric of Bethlehem the casale of Thecua, given by King Fulk; the villa of Mahumeria with its church; in the diocese of Caesarea castrum Feniculi; in the city of Jaffa the church of St Peter; the castle [castrum] of Gith; in the city of Tyre the church of Sancta Maria antiqua sedes; in the diocese of Tyre the casale of Sancta Erina; in the diocese of Tripoli the church of the Holy Sepulchre on Mont Pèlerin, the church of Sanctus Georgius in Montanis and the villa called Biuora, given in exchange for Megina; together with properties in southern Italy, Languedoc and Iberia. He confirms the freedom of the canons to elect the patriarch, exempts them from the payment of tithes and first fruits on noval lands, cultivated by them or at their expense, or providing fodder for their animals. The pope also confirms the right of the prior and canons of the Holy Sepulchre to celebrate stational Masses at and process to the Templum Domini, the Mt of Olives, Mt Sion and St Mary of the Valley of Jehoshaphat on their feasts, even when the patriarch is absent. They also have the right, in the patriarch’s absence, to excommunicate malefactors in their parishes, especially those who withhold the payment of tithes. None of their goods can be alienated or pledged, except by the common agreement, or that of the wiser part, of the canons; nor can anyone be sent overseas, suspended or expelled, unless his fault is manifest. Confratres can receive communion from the canons and be buried in the canons’ cemeteries unless they are excommunicated. The patriarch cannot extort goods from the canons and confratres. The canons are freed from payment of tithes on noval lands, cultivated by themselves or at their expense, or providing animal fodder. The election of priors by the canons is to be free from interference. The pope renews his protection of the Holy Sepulchre.

He renews their privileges and confirms their endowments, with special reference to Patriarch Amalric’s privilege of Dec. 25 1168 - Dec. 25 1169 and with some additions. The pope also confirms all possessions and churches in Sicily, Calabria, Apulia, Brindisi, Barletta, Troia, Benevento, Rome, Tuscany and all Italy, France, Iberia, and half of the properties held in common with the patriarchate itself in England, Dacia, Germany, Poland, Ruthenia, Georgia, Hungary and Constantinople. The canons have the right to decide on the disposal of those properties in their entire possession and to manage them in a vacancy in the patriarchate.

text: Jun. 20. Tusculum. Pope Alexander III writes to O. praeceptor and the brothers of the Hospital of St John of Jerusalem. He describes how he was visited by B. prior, W., Garnerius and certain brothers, as well as by E. archidiaconus Iherosolimitanus and certain other brothers, with letters from Patriarch Amalric of Jerusalem, King Amalric and other persons. These letters requested the restoration of G. to the magisterium of the Order. The prior and brothers told the pope how G. had left for a cave and resigned his office; how he had resumed the magisterium when persuaded to do so by the patriarch and other religious men; how he had spurned advice and resigned again, surrendering privately the insignia [belt, purse and seal] of a magister; and how, when the chapter agreed to receive as magister the man he nominated, he and 12 brothers had elected a brother called Castus to be magister, the election of whom the pope had confirmed. Castus has died. The pope orders the brothers to elect another suitable and honest man, who is neither too old or too young. Considering the damage and debts incurred during G.’s rule, Pope Alexander turns down the requests of the patriarch and the king, and the arguments of the archdeacon and the brothers who came with him. He confirms G.’s resignation, imposing perpetual silence on this issue. He adds that whoever becomes magister must promise to hold and keep the Order’s ancient and reasonable customs, following in the footsteps of Giraldus and R., once magistri. He must not treat major matters on the Order’s behalf or receive and fortify castles on the frontier with the Turci without the common counsel of the chapter or the greater or wiser part of it. He must not bind any brother by private oath or faith except in common chapter and for a manifest and reasonable cause. And he must not presume to make any pact with any person involving faith or an oath without the assent of chapter or the greater and wiser part of it.
