Frederick, de gratia Romanorum imperator semper augustus, Ierusalem et Sicilie rex, records that frater Hermannus magister domus sancte Marie Theotonicorum in Ierusalem and his brothers came into his presence and asked that he restore to them the terra Turonis, now held by the Sarraceni, because it had belonged to the comes Iozelinus, whose domain Frederick, with the agreement of his wife the empress Isabella, had conceded to them. Frederick had acceded to their request, but Alysa, the niece of the late Henfridus iuvenis, came to Frederick’s curia, proved that she had the right to the terra Turonis and asked the he order the land to be restored to her according to the judgement of the High Court [iuxta exguardum curie nostre]. Then the magister and brothers of the Hospital of St Mary of the Germans had produced a charter issued by King Guy of Jerusalem [of 21 October 1186], with the agreement of his consort Sybilla, in which Guy gave comes Iozcelinus and his heirs Toronum and Castrum Novum, together with Maron, Quabrinquen, Belide, Cades, Lahare, Mees and the 2 Megarae, on condition that if they were taken away by the judgement of the curia or if agreements between King Baldwin [IV] and Henfridus iuvenis were made [over] Maron, Henfridus iuvenis and his heirs would hold Turonum and Castrum Novum. The magister and brothers asked that they should enjoy the terms of the agreement, which specified that Henfridus iuvenis and his heirs would hold Turonum and Castrum Novum in exchange for an annual rent of 7000 Saracen besants and Maron and its dependencies, Quabrinquen, Belide, Cades, Lahare, Mees and the 2 Megarae. Frederick grants under seal what they have requested, stating that the rent should be divided equally between the cathena and funda of Acre, payable 4 times a year in instalments of 1750 Saracen besants. At the request of frater Lutolfus magnus preceptor et tenens locum magistri domus hospitalis Alamanorum in Accon and all his convent, with the agreement of his chapter and for the needs of his church, Radulfus Acconensis ecclesie minister leases under his seal and that of his chapter to the Hospital of St Mary of the Germans, represented by frater Lutolfus, 2 gardens situated on the banks of the flumen Acconensis for an annual rent of 75 Saracen besants of Acre weight, payable each year by the Order’s treasury [thesaurus] on the Feast of the Exaltation of the Cross. To the east of the gardens is the mill of the king. To the west is the land of the Hospital of St Mary of the Germans, to the south is the flumen Acconensis and to the north the public way. The church of Acre guarantees the Hospital’s possession of the gardens according to the customs of the city of Acre [consuetudo civitatis Acconensis], but the gardens will revert to the church of Acre should the rent not be paid or if the magister of the Hospital of St Mary refuses to confirm this agreement. text: Jul. 7. Acre. In palatio magistri hospitalis sancte Marie Theotonicorum. Frater Henricus de Honloch magister and the chapter of the Hospital of St Mary of the Germans on one side, and dominus Iacobus de Amigdala on the other, reach an agreement, sealed with the seals of the chapter and of Iacobus, over certain charters of comes Iozolinus relating to the land of Maron, rents of 7000 besants, which Iozolinus had from the funda and cathena of Acre, and other rights which Iozolinus had in the kingdom of Jerusalem. Iacobus claimed half of these by reason of his inheritance from his mother domina Agnes, the daughter of comes Iozolinus. After the intervention of friends, the parties agree the following. With the consent of his brothers in convent, frater Henricus recognizes Iacobus as the legitimate heir and invests him with half of Maron, half of the rents of 7000 besants, and half of the rights of Iozolinus in the kingdom of Jerusalem. Dominus Iacobus de Amigdalia renounces claims to the other half of Maron and the other rents and rights of Iozolinus. He agrees that the original charters should be held by the Hospital of St Mary of the Germans, who had bought the estates from domina Beatrix, the first-born daughter of Iozolinus, reserving claims to half of other properties, should they be restored to Christian hands. He promises never to challenge his sale to the Order of half of Castrum Regis for 6400 besants. or his leasing to the Order of half of Maron for an annual rent of 2500 besants, which is described in a separate charter. He agrees that should other properties, at present held by the Sarraceni, return to Christian hands, he will seek arbitration. He will never encourage any other individual to take action against the Order. Any breach of this agreement will carry a penalty of 2000 marchae argenti. Iacobus de Amigdalia leases under seal to frater Henricus de Honloch magister domus hospitalis sancte Marie Theotonicorum and the brothers of the Hospital of St Mary of the Germans his half of Maron for a rent of 2500 Saracen besants a year, which ought to be paid in Acre or in the castle called Montfort by the treasury [thesaurus] of the Order in 4 instalments of 625 Saracen besants of Acre weight. Any deferment of payment for 6 months and 20 days will lead to a fine of 1000 besants and a deferment of a year and 20 days will allow Iacobus or his heirs to repossess the property, while the other half of Maron will be occupied as a pledge until the Order’s debts are repaid. Should Maron revert to them, Iacobus or his heirs will pay the half-service owed for it. Should Maron be lost through warfare or any way that is not culpable, the rent will be decreased in accord with the decision of arbitrators.
