text: First half of 1170 (probably c. June). [122] Gibertus, domus [Hospitalis] sanctorum pauperum minister, with the agreement of all his brothers [universi collegii nostri] records under seal how dominus A. Hungrie, Dalmacie et Croacie dux [Bela III], who was intending to pilgrimage to Jerusalem with his wife, had transferred as an eleemosynary gift money worth 10000 gold besants to the Hospital and through his emissary Retchab and the Hospitaller brother Bernardus had asked the Order to buy lands, vineyards and casalia near Jerusalem, the produce of which would provide both for the duke and his wife in the Holy Land and after his death would provide for the poor in the Hospital. During his lifetime, if he and his wife resided elsewhere, the Hospital could enjoy the fruits. His heirs would have no rights to the properties, but should his sons wish to serve [famulari] the Hospital, the Order would provide them with horses and arms. Lands near Jerusalem were hard to find, but Gibertus and his brothers give the duke, not for money but out of love, castellum Emaus, Aqua Bella, Belveer and Saltus Muratus, all near Jerusalem with cultivated and uncultivated lands, vineyards, orchards [pomeria], woods, with wheat and barley, wine and fruits, and animals. The Hospital has also bought in the city of Acre a palatium, which belonged to the late Giraldus de Cuniculis and 4 houses belonging to Fulco Moneta, and outside the city an orchard [pomarium] and a casale 1 league [leuga] away for 11000 Saracen besants, drawn from the duke’s money. These properties will return annually 1100 besants. The duke and his wife will receive the income either from the 3 casalia near Jerusalem or from those in Acre, whichever is the greater. The Hospitallers do not yet have a charter of confirmation of the properties in and near Acre from King Amalric, who has travelled to Antioch, but they are confident of his agreement when he returns. Witnesses: frater Petrus de Crato clericorum magister et ecclesie custos; frater Guigo de Mahone preceptor Hospitalis; frater Castus thesaurarius; frater Piotus; frater Stephanus; frater Bernardus sacerdos et predicti negotii internuntius.

text: Jun. 20. Tusculum. Pope Alexander III writes to O. praeceptor and the brothers of the Hospital of St John of Jerusalem. He describes how he was visited by B. prior, W., Garnerius and certain brothers, as well as by E. archidiaconus Iherosolimitanus and certain other brothers, with letters from Patriarch Amalric of Jerusalem, King Amalric and other persons. These letters requested the restoration of G. to the magisterium of the Order. The prior and brothers told the pope how G. had left for a cave and resigned his office; how he had resumed the magisterium when persuaded to do so by the patriarch and other religious men; how he had spurned advice and resigned again, surrendering privately the insignia [belt, purse and seal] of a magister; and how, when the chapter agreed to receive as magister the man he nominated, he and 12 brothers had elected a brother called Castus to be magister, the election of whom the pope had confirmed. Castus has died. The pope orders the brothers to elect another suitable and honest man, who is neither too old or too young. Considering the damage and debts incurred during G.’s rule, Pope Alexander turns down the requests of the patriarch and the king, and the arguments of the archdeacon and the brothers who came with him. He confirms G.’s resignation, imposing perpetual silence on this issue. He adds that whoever becomes magister must promise to hold and keep the Order’s ancient and reasonable customs, following in the footsteps of Giraldus and R., once magistri. He must not treat major matters on the Order’s behalf or receive and fortify castles on the frontier with the Turci without the common counsel of the chapter or the greater or wiser part of it. He must not bind any brother by private oath or faith except in common chapter and for a manifest and reasonable cause. And he must not presume to make any pact with any person involving faith or an oath without the assent of chapter or the greater and wiser part of it.

In the general chapter of the Hospital of St John of Jerusalem, Rogier/Rogerius serf des poures de Crist/servus pauperum Jhesu Christi promulgates statutes dealing with the duties of the conventual prior and local commanders, the provision of physicians, the treatment of male and female patients, the ward duties of the brothers and servants, and the provision of materials for the Hospital in Jerusalem by the European provinces and by officers in the Latin East. Of the latter, the bailli/baylivus of Antioch should send 2,000 canes/brachia of cotton for making bed coverlets, and the prior of Mont Pèlerin and the bailli/baylivus of Tiberias should each send 2 quintaus/quintalia of sugar for making lectuaries and medicines. An appendix, issued after frère/frater Rogier/Rogerius de Molinis maistre/magister and frater Bernardus prior had heard testimony, lists customary regulations for the treatment of patients, including children, for the duties of the frere corvoisier and the aumonier/elemosinarius, for prayers for benefactors and for alms-giving.
