P[etrus] Dominici Sepulcri prior and his convent record that they conceded to Bernardus and his wife, who had been received into the confraternity of the Holy Sepulchre, a house with a statio, to be held for their lives, with the exception of 2 camerae and stables [stabulae], which the canons of the Holy Sepulchre will retain for the lodging of Lambertus Ptolomensis. After the death of Lambertus and his wife the Holy Sepulchre will provide Bernardus with compensation. If Bernardus and his wife decide to abandon their property and enter the community they will be provided with food and clothing. When one of them dies half of their goods will go to the Holy Sepulchre and the survivor may join the community with the other half or can continue to live in the house. After the survivor’s death the house and statio will pass to the the canons. If Bernardus and his wife should have a child he or she will inherit one third of any cash, but the rest, together with the house and statio, will pass to the Holy Sepulchre. If the survivor of the couple remarries he or she should have the property for life, but it will not be held by any new wife or husband after the survivor’s death, although she or he may retain half of any cash. If there is a child of this second marriage the cash will be divided, with a third going to the Holy Sepulchre, a third to the child, and a third to the spouse. Record of an agreement made between Maria de Sancto Lazaro, the wife of Rogerius, a cliens of the Holy Sepulchre, and Bernardus, the brother of Petrus prior Sancti Sepulcri and a cliens of the patriarch. Maria had wedded her daughter to Bernardus in the presence of the chapter of the Holy Sepulchre. Her first husband Petrus had presented the daughter with a dowry of 100 besants and had invested her with the usufruct of a vineyard that he had planted. Petrus also left Bernardus a fourth part of a house situated in Jerusalem in the platea Templi next to the house of Bentulinus, to be held after his death. Another part was left to his son, although it would pass to Bernardus if the son died. Maria challenged the gift of the house. The case was heard in the chapter of the Holy Sepulchre in the presence of patriarcha Willelmus; Petrus subprior; of the canons of the Holy Sepulchre, Anselmus cantor; Goffridus thesaurarius; magister Robertus; and in the presence of Anschetinus, quondam vicecomes Hierosolymitanus; Rainaldus de Pontibus; Goiffridus Acu. They judged that Bernardus should have the fourth part of the house acquired by Maria and her second husband Rogerius after their death; similarly another fourth part should pass to Bernardus after the death of Maria’s son. In the presence of Patriarch William of Jerusalem, who seals the charter, Riso, capellanus to Bohemond I and Bohemond II of Antioch, gives the canons of the Holy Sepulchre his houses with an apple orchard [pomerium], which he had bought from Willelmus medicus for 64 besants. They are to hold it under the same terms as he held it from Bohemond II. The houses are situated next to those of Pontius Antiocheni thesaurarius on the other side of the public way [via publica]. Riso reserves for himself one camera, to provide a small living place [habitaculum] for his servus, whom he has had baptized, for as long as he lives and serves him faithfully. Petrus Dominici Sepulcri prior, together with the canons, gives Arnulfus, the son of Bernardus/Bernaldus Syrianus, and his heirs houses built over vaults exchanged with the Hospital [of St John] and situated over the Holy Sepulchre’s oven, which is on the road that leads to Mt Sion, and a statio next to the oven for an annual census of 9 besants, payable at Easter. If the bases of the houses resting on the vaults are damaged, that party, the Holy Sepulchre or Arnulfus, which has been negligent will be responsible for repairs. If Arnulfus extends the houses and wishes to sell, the Holy Sepulchre will have preemption rights, paying 1 silver mark less than the price. Otherwise any purchaser, burgensis vel Syrianus, will be subject to the same rent. The cost of any repairs to the statio will be borne by Arnulfus. The canons give custody of the key to the cistern to Arnulfus, who must provide the procurator of the oven with water if he needs it when making repairs. Robertus Nazarenus archiepiscopus, Fulcherius Tyrensis archiepiscopus, Bernardus Sydoniensis episcopus, Rorgo Ptolomaidensis episcopus, Helias of Tiberiadensis episcopus, Rogerius Ramathensis episcopus and others judged that the fruits of the vineyard should be enjoyed by the canons, but the canons, moved by charity, have remitted the fruits to Andreas and have conceded the vineyard to him for life on condition that they receive a third of the harvest and the tithe, and the vineyard itself on his death. text: 1158 - 1159. Arnaldus Dominici Sepulcri prior, with the agreement of his chapter, records exchanges made at Mahumeria with certain burgenses of the village [villa]. (1). An agreement made with Guibertus Papasius, with the consent of his wife Usanna, in which he exchanges the vineyard next to the cemetery and church of Mons Gaudii, inherited by Usanna, for a part [pars] at the far end [extrema pars] of the great vineyard that is next to the upper road [via superior] and adjoins another vineyard belonging to Guibertus on which he owes decima et terraticum. Tithes will be owed on Guibertus’s acquisition. [2]. An agreement with Gauterius Carpentarius, who exchanges a vineyard adjoining the one that had belonged to Guibertus Papasius for a vineyard in another part of the great vineyard, next to the high road [magna via], for which he will owe tithes. (3). An agreement with Ainardus Cavallom, who exchanges part of a vineyard, next to that which had belonged to Gauterius Carpentarius for another part of a vineyard in the great vineyard, this also being next to that of Gauterius Carpentarius. Tithes will be paid. Ainardus, impelled by poverty and having nothing with which to feed and bring up his wife and children, has sold this part to Martinus Carpentarius of Mons Gaudii for 26 besants with the consent of his lord and the court [curia]. (4). An agreement with the daughters of Pontius Faverius and their husbands. They exchange 30 jugera of cultivated land in the territory of Kalandria, owing decima et terraticum, for 2 petiae of a vineyard in valle Sancte Marie, one of 4 jugera, the other of 2 jugera, which had belonged to frater Petrus de Rametis, for which they will give tertia et decima. (5). The prior gives Stephanus Pastinace the vineyard that had belonged to frater Arnaldus on condition that he cultivates the wasteland and pays medietas et decima annually. (6) An agreement made with Helyas and Amicus, his relation [gener], in which they exchange part of their garden which is next to the berquilium, for a pars of uncultivated land that had come to the canons in their agreement with Robertus de Retest and adjoins land belonging to Helyas. (7). An agreement with the hospitale at Mahumeria in which the hospitale exchanges part of a garden that stretches between the berquilia of the Holy Sepulchre and the hospitale for 2 jugera of the vineyard that had belonged to frater Stephanus Ortalis. Tithe will be owed for this. (8). Frater Robertus Porcarius gave himself and all his possessions to the Holy Sepulchre [on becoming a confrater]. This was confirmed at Mahumeria by domnus A. prior, assisted by the burgenses of the village [villa] in plenarie curie, to whom Robertus handed a staff [baculum], giving everything to the Holy Sepulchre. Robertus enumerated his possessions, specifying land next to that of Robertus Ungarus, which had been given by Prior Giraldus to him and his wife, previously married to Umbertus, but which he had abandoned because he had not been able to cultivate it; some adjoining land given by Prior Petrus, who later became archbishop of Tyre, to Robertus in an exchange for land he had bought from Galterius Bela; and land nearby which Prior P. had given and on which was owed terraticum et decimam. (9). Prior Arnaldus and domnus Robertus de Retest came to Mahumeria and agreed on the boundaries of their respective territories. They chose an elderly Sarracenus called Pes Tortus, a homo rusticus of Robertus, to provide evidence of the boundary. This survey took place in the presence of the following canons of the Holy Sepulchre: domnus Petrus elemosinarius; domnus Bernardus Antiochenus; frater Pisanus; Petrus Judaeus; Johannes interpres; Arbertus; Stephanus. The son of the aforesaid Robertus [de Retest] was also present.

In the presence of Patriarch Amalric [of Nesle] of Jerusalem, Arnaldus Sanctissimi Sepulcri prior and his convent give the men [homines] of Mahumeria the vineyards of domnus Hugo de Thorso and domnus Radulfus Parisiac[ensis] on the following conditions. Half of all fruits and a tithe are to be brought to the curia Sancti Sepulcri de Mahumeria or to whatever place in Mahumeria the dispensator Mahumerie ordains. Half the price achieved in any sale [must be surrendered to the Holy Sepulchre]. Sales to the Templars, the Hospitallers, any church, milites or to any that might harm the Holy Sepulchre are forbidden. If there is evidence of bad cultivation the dispensator Mahumerie, together with 4 or 5 witnesses, will give one warning and will then transfer the vineyard to another tenant, paying only half a marcha argenti for it. The planting of vines is allowed only on Holy Sepulchre land. If the canons wish to enlarge their village [villa], they can create mansiones on these vineyards. Hugo Cesaree Palestine dominus, with the agreement of his wife Ysabel and the advice of his probi homines, makes a sealed grant to Petrus prior and the Latin canons of the Holy Sepulchre. He gives them the mountain next to the garden of Feissa, where rise the waters that feed the aqueduct. The land stretches from the road that comes from Braicaet towards the Casale Sancti Sepulcri, eastwards, by way of the cavea which is between two hills and the river bed [torrens] that flows in winter, to a small hill situated between the said mountain and the mountain of Broiquet; and from the bed of the river bed towards the aforesaid small hill along the side [per crepidinem] of the small hill, as designated by crosses, towards a hillock [monticulum], called the lime kiln [calcis fornax], and then to the south to another hillock, which is not far away, which was the old lime kiln [calcis fornax], extending along the side of the hill in a straight line to a wall [spina] on the plain, which divides the casale of Faisse, belonging to the Holy Sepulchre, from the casale of Sabarim, belonging to the Hospital. The boundaries were drawn by the canons of the Holy Sepulchre with Georgius and his son Balduinus. Hugo retains the right to repair the old aqueduct and the spring that feeds it, in order to convey water to his sugar cane plantation at Casale Bubalorum. In return for this he will provide the canons with half a quintala [of sugar] each year from a sugar cane press [macera], and if there is a surfeit [amplius] he will provide a whole quintala. He can construct another aqueduct and dig another spring to lead water to the aforesaid casale. Hugo also confirms the gift made by his grandfather Eustachius Granerii and his father Galterius, with the boundaries that were established. He adds the privilege that the canons can sell or buy, weigh and measure and transport by land or sea without any payment of usaticum or exactio throughout his land, within and outside the city of Caesarea. The canons give Hugo 400 besants in return for the gift and confirmation. In the presence of Patriarch Amalric of Jerusalem, at the mediation of Heraclius archidiaconus Hierosolymitanus and magister Monachus domni patriarche cancellarius, and with the consent of both their chapters, Bernardus Liddensis episcopus and Petrus Dominici Sepulcri prior come to an agreement. Bernardus gives the canons of the Holy Sepulchre half of the tithes taken on harvests, wine, oil, beasts, fowl and other things in a casale called Bermenayn. Petrus concedes to the church and bishop of Lydda half of all the tithes of harvests of the 4 casalia, referred to in a charter of gift from Rogerius quondam Liddensis episcopus, of Capharuth, Git, Kephrecylta and Porfilia. Of these, the first 2 were given and the others exchanged. Exempted from the payment of tithes of all 5 casalia will be fodder for beasts and feeding for fowls, but half tithes will be paid on the products of the canons’ own labour. Bernardus, with the consent of his chapter, gives the canons of the holy Sepulchre the right to churches and the building of new ones in the 5 casalia, with full parochial rights, although the priests [sacerdotes] appointed by the canons should be obedient to the bishop, who retains the right to summon them to a synod, to bless the chrism and oils they need, to consecrate altars and ordain clergy, and to impose interdicts and excommunications.
