text: Sept. 24 1109 - Mar. 24 1110. After an account of the liberation of Jerusalem, the election of Godfrey [karissimus frater meus] to the office of sancte civitatis gubernator and Godfrey’s death primo principatus sui anno peracto, Baldwin, ab exultante clero principibus et populo primus rex Francorum nutu divino electus atque statutus, describes how he was crowned in the church of Bethlehem and announces that he wanted to raise Bethlehem to the status of bishopric. After consulting Arnulfus archidiaconus and the chapter [of the church of the Holy Sepulchre] in Jerusalem, he sent Arnulfus archidiaconus and Aicardus decanus to Rome for advice. Pope Paschal II ordered Archbishop Gibelin of Arles to hear the case presented by Arnulfus and Aicardus and to follow them to Jerusalem. Gibelin, on the orders of Paschal and with the agreement of the chapter of the church of the Holy Sepulchre, chose and installed Aschetinus eiusdem ecclesie cantor, who had already been elected bishop of Ascalon, as bishop of Bethlehem. [21] Ascalon was subjected to Bethlehem. Confirming this, Baldwin, dei gratia rex Ierusalem Latinorum primus, also confirms the eleemosynary gift [to benefit among others the soul of Godfrey misericordissimus dux] he had made to the church of Bethlehem of the villa of Bethlehem and the following casalia: Bedar in the territory of Acre; Seylon in the territory of Nablus; Bethbazan/Bethbezen/Bethlezen next to Bethlehem; Zeophir/Zoephyr and Carcapha/Carchapha/Carapha in the territory of Ascalon. He has solved the disputes Bethlehem had had with the church of Jerusalem through the exchange of lands and vineyards in the neighbourhood of Jerusalem. He threatens judgement on any who should dispute this grant after his death and promises to confirm any gift to Bethlehem made by his magnates, knights and burgesses [optimates, milites, burgenses]. The charter is dated to the period in which Archbishop Gibelin of Arles, the papal legate, was elected to the patriarchate of Jerusalem. Witnesses: Arnulfus archidiaconus; Aicardus decanus; Eustachius Granerius; Anselmus turris David custos; Radulfus de Fontaneto; Pisellus vicecomes; Simon ducis filius; Anfredus vir religiosus; Girardus camerarius and many others.

Pope Paschal II informs the king, churchmen and laity in the kingdom of Jerusalem of his reaction to accusations that Patriarch Arnulf was of illegitimate birth, had had relations with women and had been forced on the church of Jerusalem by the king. The leader of the party of accusers was Archbishop Evremar of Caesarea, using as witnesses two women, one being the wife of Girardus and the other said to be a Muslim [Sarracena]. Paschal had despatched a legate to the East and Arnulf and many of his brother bishops had been summoned to Italy. Many letters in support of Arnulf were sent to Rome, stating that he had already been given a papal dispensation, and there were protests at the one-sided decision of the papal legates. Aschetillus episcopus Bethlehem, Hugo abbas monasteruii de Valle Iosaphat, Arnaldus prior ecclesie de Monte Syon, and Petrus and Guillelmus canonici ecclesie dominici Sepulcri swear that they elected Arnulf to the patriarchate without fear of royal violence. Arnulf swears that he is innocent of any criminal charges. Pope Paschal restores Arnulf to the patriarchate.

In the absence of Patriarch Fulcher of Jerusalem, who had been on a journey to Rome, Aimericus, the prior of the Mount of Olives and his canons had prevented the canons of the Holy Sepulchre from holding their customary stational service at the church of the Mount of Olives during the Ascension procession, on the grounds that they could only use the church when the patriarch was present, since it had equal status with the Holy Sepulchre. On his return, the canons of the Holy Sepulchre brought a complaint against the canons of the Mount of Olives to a synod, at which were present Patriarch Fulcher himself and P[etrus] archiepiscopus Tyrensis, B[alduinus] archiepiscopus Cesariensis, L[etardus] archiepiscopus Nazarenusi, R[adulfus] episcopus Bethleemitę, C[onstantinus] episcopus Liddensis, R[ainerius] episcopus Sebastensis, F[redericus] episcopus Achonensis, A[rbertus] episcopus Tyberiadensis, A[dam] episcopus Paneadensis, A[malricus] episcopus Sydoniensis, M[ainardus] episcopus Berithensis, G[aufridus] abbas Templi Domini, P. abbas Sanctę Marię Josaphat, A[milius] abbas Sanctę Marię Latinę, R. abbas Sancti Samuhelis, H[erbertus] abbas Sancti Abacuc, E[ngerannus] prior Montis Syon, H[ugo] prior Templi Domini, R[adulfus] prior Sebasteni. The synod found for the Holy Sepulchre and judged that the canons of the Mount of Olives should come barefooted to the Holy Sepulchre. So the prior [Aimericus] with his canons - Guido, Bonicius, Johannes Berruier, Durandus, Odo and Zacharias – accompanied as an act of humility and devotion by P[etrus] archiepiscopus Tyrensis, A[dam] episcopus Paneadensis and M[ainardus] episcopus Berithensis, came to make satisfaction. It was recorded by all present, together with the patriarch, that since the expulsion of the Muslims [Sarraceni] the Holy Sepulchre had the right to process to any church inside or outside Jerusalem on the following feasts: the Purification to the Templum Domini, the Ascension to the Mount of Olives, Pentecost to Mount Sion and the Assumption to St Mary of the Valley of Jehoshaphat. In these churches the convent of the Holy Sepulchre had primacy and could hold stational services. If the patriarch was absent, the prior of the Holy Sepulchre would sing Mass and preach to the people.

text: Dec. 15. Lateran. Pope Innocent III orders the patriarch of Jerusalem, the archbishop of Tyre and the bishop of Acre to release the Knights Templar from a sentence of excommunication improperly imposed on them by the bishop of Sidon. The bishop of Tiberias had complained that the magister and brothers of the militia Templi had held back 1300 besants and other goods of his diocese, which his predecessor had deposited with them. The pope had appointed the bishops of Sidon and Biblium as judge delegates in the case, but the Templars had sent some brothers to inform him that when they disembarked on a Wednesday at Tyre, having returned from the principality of Antioch where they had been involved in a war between the prince of Antioch and the [Muslim] lord of Aleppo, the bishop assigned the following day, the Thursday, for a hearing of the case. The magister could not attend but sent 2 brothers, who promised to respond to the complaint of the bishop of Tiberias and to observe any sentence delivered by the bishop of Sidon, even though the bishop of Biblium was absent. But the bishop of Sidon refused to hear any arguments and demanded the return of the besants to the bishop of Tiberias by the following Sunday; otherwise he would excommunicate all the Templars, in the West as well as in the East. The 2 brothers hurried to Acre and the magister appealed to the patriarch to settle the case and avoid scandal. But on the following Sunday the bishop of Sidon solemnly and publicly excommunicated the whole Order in the church of the Holy Cross in Tyre. The pope orders the patriarch to look into the matter and, if the bishop of Sidon is guilty, to suspend him from office until the papacy lifts the suspension and to absolve the Knights Templar.

Pope Innocent III replies to King Leon of Cilician Armenia, whose representative, the miles Rob[ertus] de Margato, has informed the pope of the case of Rupinus, the son of R[aymundus], the elder son of Prince Bohemond [III] of Antioch, and Leon’s niece A[aliza], who was recognized as legitimate heir to the whole of the principality of Antioch apart from the dowry of I[sabella], Prince Bohemond’s wife, but was disinherited by Count Bohemond of Tripoli, the magistri of the Hospital of St John of Jerusalem and the Knights Templar [militia Templi], and the commune [communia] of Antioch, while through bribery the count was asserted to be the legitimate heir. Innocent decides to reserve the case to his legates who will sail on the next passage and will decide through law not arms. In the meantime he exhorts Leon to peace so that there can be appropriate defence against the Sarraceni. He orders Count Bohemond to do nothing to prejudice the case. He is sending back Leon’s representative.
